Litigation

The Litigation Group provides aggressive but practical representation to individuals and businesses in a variety of state and federal civil litigation matters. In addition representation is provided to clients in various arbitration matters before the American Arbitration Association (AAA), New York Board of Trade (NYBOT), and self-regulatory organizations including the National Association of Securities Dealers, Inc. (NASD), New York Stock Exchange (NYSE) and National Futures Association (NFA). The Group's litigators are admitted to practice in Pennsylvania, New Jersey, Maryland and Massachusetts state courts and in each federal district court for Pennsylvania and Maryland, the 3rd Circuit and the United States Tax court.

The Group engages in Orphan's Court litigation, business and commercial litigation, public investor's litigation and arbitration, real estate litigation, tax litigation and personal injury and wrongful death litigation.

    Orphan's Court: Related to our Estate Administration Group, the Litigation Group engages in complex Will and Trust contests, guardianship issues and advance medical directives or living will matters.

    Business and Commercial Litigation: We represent businesses in matters that vary from complex contract disputes to business break-ups to securities litigation and arbitration matters, including, but not limited to, securities fraud. Business matters vary from representing businesses who have purchased defective products from suppliers or manufacturers, to contract disputes, to representing businesses in disputes with distributors. Commercial matters include representing businesses who are owed payment for services rendered or products provided by them to another business. Recognizing that litigation is many times a last resort or option for most clients, it is our ability to aggressively assert our clients rights while negotiating only when advantageous to them that allows us to provide a cost-effective solution to difficult business disputes.

    Public Investors Litigation and Arbitration: We represent public investors who have received improper advice or investment services from stockbrokers, financial advisers or planners and others in United States District Courts and before self-regulatory organizations such as the National Association of Securities Dealers, Inc. (NASD), the New York Stock Exchange (NYSE) and the National Futures Association (NFA). Claims may include unsuitability, churning, unauthorized trading, failure to execute, failure to diversify, improper liquidation of margin account, failure to supervise, market manipulation and more. In addition, the group represents persons and businesses before the New York Board of Trade (NYBOT) and investors, promoters and issuers in disputes related to private offerings, unregistered offerings and other securities transactions.

    Real Estate Litigation: We represent individuals and businesses in real estate matters including, but not limited to, disputed commercial and residential sale and lease transactions, boundary and right-of-way disputes, and various landlord-tenant matters for commercial and residential properties.

    Tax Litigation: Nothing is as fearsome or potentially devastating to an individual or business as the Internal Revenue Service and its far-reaching powers and authority. We have successfully resolved complex tax issues for individuals and businesses where their liability was significantly decreased despite the apparent validity of the tax obligations through litigation and the settlement thereof.

    Personal Injury - Wrongful Death: The Group provides personal attention with compassion to individuals seriously injured or who have lost a loved one through the fault of another. We have represented plaintiffs and defendants in personal injury claims, medical and dental malpractice cases, nursing home abuse matters, and other health care related issues.
